Olivia Wilde’s legal win against ex Jason Sudeikis amid bitter custody battle
A New York judge reportedly ruled in favor of actress Olivia Wilde in her ongoing custody battle against Ted Lasso star Jason Sudeikis on Wednesday – after she accused her former fiancé of trying to embarrass her when publicly serving papers earlier this year

Olivia Wilde served custody papers on stage in April
A New York City judge has reportedly ruled in Olivia Wilde ‘s favour amid her custody battle with former fiancé Jason Sudeikis, according to PageSix.
The two stars are currently locked in a custody battle regarding where to raise their two children, following their split in November 2020.
According to PageSix a judge ruled California is their children’s home state on Wednesday, following Jason’s request to raise their family in Brooklyn.
A legal filing, seen by Page Six, reads: “Judge Powell and this Referee agreed that New York was not the home state of the subject children; but rather California was the children’s home state.

“Therefore, for the reasons stated on the record on July 15, 2022, respondent’s motion to dismiss the custody petitions filed on October 21, 2021 is granted as this court finds that New York does not have jurisdiction to hear the custody petitions as New York is not the home state of the subject children.”
American publication TMZ reports that after a zoom hearing last month, two judges have agreed New York is not the children’s home so the custody case will take place in Los Angeles.
The ruling comes after Olivia allegedly claimed her ex sought to ’embarrass’ and ‘threaten her’ when he publicly served her custody papers on stage at CinemaCon in Las Vegas earlier this year, according to the DailyMail.
The former couple share two young children together
In court filings, it was alleged the two stars have been clashing over Olivia’s plans to relocate to London in 2023 with their children Otis, eight, and Daisy, five.
According to court papers seen by the DailyMail, the Don’t Worry Darling director told her former fiancé she intends to make LA the primary residence for her and the children until she relocates to the United Kingdom next year.
Ted Lasso creator Jason intends to return to New York – a state couple previously lived together – and filed a custody petition which resulted in Olivia being served on stage as she spoke at CinemaCon in Las Vegas on April 26.

The mum-of-two – who is currently dating Harry Styles – was handed custody papers by her ex-husband and father of her children, while on stage promoting her new film Don’t Worry Darling in April.
Olivia, 38, was mid-presentation when she reportedly received the legal documents from Jason – best known for starring in Ted Lasso.
The dad-of-two reportedly hired a process server to hand crucial documents over to Olivia concerning their two young children, but claims he had no idea they would be served so publicly.
A source told PageSix at the time: “Papers were drawn up to establish jurisdiction relating to the children of Ms. Wilde and Mr. Sudeikis.
“Mr. Sudeikis had no prior knowledge of the time or place that the envelope would have been delivered as this would solely be up to the process service company involved and he would never condone her being served in such an inappropriate manner.”
It had initially been reported that the documents were an unsolicited script sent by a fan in the hopes of receiving Olivia’s attention.

Olivia references the awkward incident in the court papers – claiming Jason purposely intended to catch her off guard and embarrass her professionally.
“Jason’s actions were clearly intended to threaten me and catch me off guard. He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible,” the Daily Mail report the actress saying in the documents.
“The fact that Jason would embarrass me professionally and put our personal conflict on public display in this manner is extremely contrary to our children’s best interests.

“Since Jason has made it clear that we will not be able to work this out for our children’s sake outside of the court system, I filed a petition for custody in Los Angeles.”
IJason had allegedly been “reluctant” to serve his ex, because he still cares “deeply for her”, but had been worried by statements from Olivia during their conversation.
He claims he hoped the papers would be served in a “benign manner” and reportedly wanted to avoid his requested service taking place at Harry Styles’ home, where Olivia is currently residing.

“I did not want service to take place at the home of Olivia’s current partner because Otis and Daisy might be present. I did not want service to take place at the children’s school because parents might be present,” Jason says in the court documents.
He goes on to claim he only learned Olivia would be served in public days later when the ComicCon incident went viral and made headlines across the world.
The Mirror has contacted representatives for both Olivia and Jason.
Jason and Olivia ended their engagement in November 2020, after first striking up a romance in 2011 and welcoming two children into the world during their time together.
It’s believed Olivia began dating current boyfriend Harry – who stars in her new movie Don’t Worry Darling – around January 2021.
